Seminar 2: Protecting your position – contractual and statutory protective measures in construction projects

In a construction project context, when do you need to think about protecting your rights and interests and what are the various statutory and contractual mechanisms available for doing so?

This seminar will discuss:

  • Types of security from bank guarantees through to tripartite agreements and some less traditional methods of security;
  • Assessing the financial viability of counterparties and guarantors;
  • Other common risks and how to minimise them, including PPSA in the construction space; and
  • Practical issues with enforceability - when to take steps to protect your rights and interests and how best to do so.
