Carter Newell is delighted to be a spotlight partner at the upcoming Regional Airport Development Conference at which partners Bronwyn Clarkson and Glenn Biggs will explore the legalities of Airport Development.

Bronwyn and Glenn's session will explore a range of key legal issues which airport owners and operators should consider in undertaking or progressing airport development:

  • Examining leasing documentation for airport land use - including use of agreements for lease, legislative compliance, airport specific aspects of leases, and retail v commercial leasing issues;
  • Understanding methods to implement development controls - looking at compliance with the Master Plan, regulatory approvals, use of community titles schemes, and use of design controls;
  • Considering other commercial agreements associated with airport development - including licenses and concessions, managing ground transport operators, other complimentary services and contracts with key suppliers and service providers;
  • Reviewing risks to airports and existing stakeholders - including airlines, existing tenancies, business interruption, and increased liability from new occupants;
  • Considering risks from new commercial tenancies - including specific insurance and indemnity clauses in lease terms, and planning, design and construction of new commercial premises;
  • Examining risks to third party airport users - such as contractors, looking at specific areas such as common user airside areas, and recreational and general users of landside areas.
