Resources Legislation Update - Brisbane

Sep 2016 |

Join our complimentary seminar as we discuss three important changes in the resources industry:

Mineral and Energy Resources (Common Provisions) Act

Key changes introduced by the Mineral and Energy Resources (Common Provisions) Act and Regulations will commence on 27 September 2016.  Bronwyn Clarkson will outline some of the main impacts the legislation will have for participants in the resources industry, including:

  1. Registration of CCAs on title;
  2. Changed rights to access land; and
  3. The concept of ‘restricted land’ and its application to mining and petroleum.

Chain of Responsibility Legislation

The changes introduced by the Chain of Responsibility legislation in Queensland have received widespread attention and comment.  The changes have given the environmental regulator unprecedented enforcement powers by enabling it to recover clean up costs from a wide range of “related parties”.

James Plumb will provide a short overview of the extent of the changes introduced by the new legislation, and provide his views on:

  1. The likely interaction of the new powers with DEHP’s existing Enforcement Guidelines;
  2. The potential impact of the new regime on Queensland asset sales; and
  3. Insurance implications for resources companies.

Changes to the Water Act

Within the next three months, both petroleum and mining tenure holders will be impacted by new obligations under the Water Act. Johanna Kennerley will be discussing the practical implications of those changes, including:

  1. How and when you need to enter into make good agreements with landholders under chapter 3 of the Water Act; and
  2. New obligations of mining tenure holders from December 2016.
