After wide spread commentary that the Insurance Contracts Act was not achieving its intended results, draft amendments to sections 40(3) and 54 are proposed to give insurers greater protection in claims made and notified policies.

Insurer Successfully Defends Joinder Application

In the case of the Owners, Strata Plan No.50530 v Walter Construction Group (in Liq.) & Ors [2007] NSWCA 124, an insurer successfully defended an application to join it to proceedings pursuant to section 6 of the Law Reform (Miscellaneous) Provisions Act.
