The sixth edition of the Injury
Liability Gazette, compiled by the
Carter Newell Property & Injury
Liability Team, outlines decisions
handed down around Australia.
Along with my fellow partners
Glenn Biggs and Stephen White,
our Property & Injury Liability
team have compiled this latest
edition of the Gazette to provide
practical information on recent
cases relevant to insurance
professionals.
This edition considers recent
decisions involving assessment
of damages, occupier’s liability,
recreational activities, obvious
risks and workplace law and
policy interpretation. We also look
at the basis behind the court’s
dismissal of a worker’s claim
against his employer in the case
of
Schonnell v La Spina, Trabucco
& Co Pty Ltd
[2013] QCA 324
following a fall from an allegedly
defective ladder, where the court
found that the employer’s system
of inspection was adequate and
reasonable.
