Remaining blasé about foreign corrupt practices law is an increasingly risky game

Nov 2014 |

Global anti-corruption initiatives and enforcement actions are on an upward trajectory.

There has been a strong focus on anti-corruption investigation and enforcement actions in the USA for many years, but until very recently Australia had not had a single prosecution for bribery of a foreign public official.  However the landscape is quickly changing and the high profile case of Securency International and Note Printing Australia has resulted in our first prosecution under Australia’s anti-bribery laws. The prosecution of executives from other Australian companies is currently being considered.

No longer can Australian companies, particularly those with operations overseas (or those with a nexus to a foreign jurisdiction), be ambivalent about the way they do business abroad.  Bribery of foreign public officials can result in serious financial and reputational consequences for companies, and even criminal sanctions.

This joint presentation between Carter Newell Lawyers and KordaMentha will provide you with an insight into the issue of global corruption and the key compliance measures that your company can take to minimise the risk of falling foul of the law.

Specifically, our presentation will examine:

  1. the scourge of global corruption and the efforts of law enforcement agencies to tackle it through increasing levels of cross-border co-operation;
  2. the anti-corruption legal frameworks in the jurisdictions of Australia, US, UK and key developing countries;
  3. case examples of companies subject to anti-corruption enforcement action – where they went wrong and how it could have been avoided;
  4. how your organisation can mitigate the risk of your employees, contractors and agents engaging in acts of bribery abroad through the adoption of a rigorous corporate compliance program that is practically and effectively implemented.
