In this presentation, the Aviation Team looks at the increasing trend of waiver of subrogation expectations in commercial aviation contracts and their knock-on effects in corresponding aviation insurance policies.

Glenn Biggs, Partner and Shannon O'Hara, Senior Associate will also discuss:

  • The mechanics of subrogation and how that right (or risk depending on your perspective) can be managed between parties.
  • Key aviation case summaries dealing with this issue.
  • A breakdown of subrogation clauses commonly seen in aviation contracts.

While subrogation waivers can sometimes look the same, they often have different trigger points or scope of application. They may be at cross purposes with an insurer’s interests and this presentation will also discuss the ramifications of a waiver agreed without the insurer’s consent, and a hull insurer’s right of subrogation against another insured on the same policy.
