Injury Liability Gazette 11th edition

Nov 2019 | Insurance

The Injury Liability Gazette 11th edition provides a practical and helpful summary on recent liability and personal injury decisions relevant to insurance professionals.

The cases examined in this edition, including decisions relating to workplace law, occupiers’ liability, sports and recreational activities and state and local authorities, highlight the broad array of litigation risks now facing insurers and insureds alike. Our Property & Injury Liability team have compiled this Gazette to provide a synopsis of cases relevant to Carter Newell’s insurer, broker, professional and corporate clients.

Of particular note in this edition are the recent decisions of Caffrey v AAI Limited [2019] QSC 7, Sills v State of New South Wales [2019] NSWCA 4 and YZ (as pseudonym) v The Age Company Limited [2019] VCC 148. More and more we are seeing matters of this nature becoming more prevalent within the industry and we therefore highlight the importance of these three decisions due to the topical nature of each case, in expanding liability for psychiatric harm for those persons whose jobs necessarily involve exposure to traumatic events.

As a premier legal firm with one of the largest insurance practices in Australia, with offices in Brisbane, Sydney and Melbourne, we are confident this edition will be a useful resource for our readers.
