Carbon Capture and Storage – Liability Issues

Mar 2008 |

Carbon capture and storage (CCS), involves a lengthy process of capturing the carbon dioxide from industrial processes, transporting the carbon dioxide to the storage site and injecting it into the site for long term storage.

This whole process attracts key liabilities and at this stage, the State and Federal governments have not provided the industry with any great clarity on this issue. Who is going to be liable for the storage and what form of legal framework will be initiated?
