Aug 2009 |A recent decision in the Supreme Court of Queensland has confirmed that a respondent to a claim made pursuant to the Building and Construction Industry Payments Act 2004 (Qld) may avoid summary judgment for a debt where the applicant has engaged in misleading and deceptive conduct under the Trade Practices Act 1974 (Cth).
