Greg Stirling works in various aspects of litigation and insurance law since being admitted as a solicitor in 2009.
Greg has experience in a range of complex and high-value professional indemnity, employment practices liability and D&O liability claims.
He has acted as defence counsel for insurers and their insureds, with a particular focus on claims involving solicitors, barristers, accountants, and design & construction professionals.
Greg’s experience in solicitors’ negligence claims spans a variety of practice areas, including:
- Conveyancing Errors: Such as alleged failures to identify easements, encumbrances, zoning issues, missed deadlines, and registration errors.
- Litigation Management Errors: Including failures in managing deadlines, improper advice on litigation strategy, and errors in the conduct of proceedings.
- Estate Planning Errors: Including alleged errors in drafting wills or trusts, improper tax advice, or failure to consider relevant legal aspects, resulting in claims against solicitors for damages or losses.
- Commercial Transactions Errors: Such as failures in advising on the structuring of deals, failure to identify potential risks in contracts or corporate structures, and alleged errors in the execution or advice surrounding commercial transactions.
Greg’s approach to defending solicitors in these negligence matters is pragmatic and client-focused. He works to achieve early and commercial resolutions wherever possible, minimising the risk of protracted litigation and reducing the potential for reputational harm to his clients.
He also has experience acting in the full spectrum of disputes, from unlitigated claims to complex litigation in the State and Federal Courts. He regularly appears in Court and represents clients in mediation and dispute resolution processes.
Greg’s employment practices expertise includes unfair dismissal, general protections, discrimination and workers’ compensation claims.
Greg’s expertise also extends to advising and acting on behalf of insurers in complex coverage matters. Prior to joining Carter Newell, Greg worked for an international firm providing advice to insurers in the defence of litigious claims in a range of professional indemnity matters.
