About Matthew
Matthew Gerathy is a Partner in the General Liability team at Carter Newell in Sydney. He is an expert litigator with over 25 years' experience in insurance law and claims disputes.
Matthew leads Carter Newell’s general liability team in New South Wales. Specialising in personal injury, property damage and recoveries insurance litigation for defendants, Matthew’s clients include multinational head contractors and national subcontractors, large government and private occupiers, national service providers, road authorities and care giving institutions. Many of his clients are self-insured, or have significant levels of self-insured retention, and he takes the time to understand their businesses and the issues that matter most to them.
Matthew advises across most major lines of insurance, with special expertise in building and construction and occupier’s liability claims. He advises on public liability claims generally, policy coverage issues, and the rights, interests and liabilities that arise under contract, including the interpretation of contractual indemnity and insurance procurement clauses.
His work covers wide-ranging personal injury, property damage and recoveries litigation, claims for indemnity or contribution between joint tortfeasors and complex multi-party insurance disputes. His approach focuses on the evidence needed to defend claims, to transfer risk to other parties by contract or as a joint tortfeasor, and the early identification of the best defence strategy.
An astute strategist, Matthew has resolved hundreds of complex disputes for his clients. He works across both alternative dispute resolution and contested litigation defences, and has extensive advocacy experience. Matthew takes his clients’ reputational risk as seriously as they do, and he is conscious of the need to control costs and to set an appropriate Reserve quickly and accurately.
He is admitted in New South Wales and the High Court of Australia, and has also conducted large and complex litigation in Queensland, the Australian Capital Territory, Victoria and South Australia.
