Recent Key Insurance Cases
The first part of our session will review recent insurance cases on issues such as insureds’ duties of disclosure and the ramifications of misrepresentation, brokers’ duties of care, insurers’ duties of good faith and circumstances in which waiver and estoppel may apply, the relevance of insurance policies to litigation and finally how defence costs are managed when an insurer declines indemnity.

Terms of Settlement – “the Snake in the Grass”
We all know how settlement agreements or terms of release work and their purpose; be it for first or third party insurance claims, commercial disputes, property transactions or simple agreements. This session is not a ‘back to basics’ but an exploration of the damage that can be done when parties are too focused on the deal and become ambivalent about how or if written terms will be used. This session is called the “Snake in the Grass” because parties often fail to see the real mischief in settlement agreements until it’s too late.
