Johanna Kennerley is a Partner in Carter Newell's Energy & Resources and Planning & Environment teams.
She provides environment law services for the entire life cycle of resources, construction, extractive industries and other industrial projects including initial project approvals, compliance and incident management. Johanna also has a particular focus on the ‘end of life’ rehabilitation and decommissioning obligations of resources and extractive industry projects. She also regularly advises clients on Queensland’s planning regime, including representing clients in the Planning and Environment Court.
Within the resources sector, Johanna also has experience working on the sale and acquisition of mining and petroleum projects, advising on the impact of various state-based mining and petroleum regulatory regimes, advising on and preparing operating and joint venture agreements, land access and compensation arrangements, overlapping tenure negotiations, pipeline land access projects. In addition, Johanna has experience in the NSW jurisdiction, particularly regarding petroleum exploration under the Petroleum (Onshore) Act 1991 (NSW).
Johanna also undertakes real property work in the resources and extractive industry sector, including acquisitions of strategically important property for resources projects, undertaking extensive real property due diligence including advising on town planning obligations and exemptions, dealing with state leasehold land including applying for consent to freehold, and negotiating and preparing easements, leases, and options relating to real property.
In addition, Johanna assists the construction contracts team with the preparation of contracts for new infrastructure projects, pipelines, water supply, joint ventures, mining services and property development for a range of public and private clients.
Johanna has significant in-house experience gained through multiple secondments within the Queensland and New South Wales jurisdictions.
Johanna is an active member of the Queensland Environmental Law Association (QELA), and is currently serving on the sub-committee arranging the periodic seminars. Johanna has also completed her Master of Laws, specialising in Environmental Resources Law at QUT.
