Carter Newell's 12th edition Injury Liability Gazette highlights a number of topical judgments and provides useful, practical and current information to our insurer, broker and professional and corporate clients. 

Of particular note is Dickson v Northern Lakes Rugby League Sport & Recreation Club Inc. & Anor (No.2) [2019] NSWDC 433, in which the plaintiff’s common law claims against a local rugby league player and his sports club were rejected as the Court held the player had not intended to injure the plaintiff while performing an illegal spear tackle. 

In Masson v State of Queensland [2019] QCA 80, the State of Queensland was found vicariously liable for the failure of paramedics to follow the Clinical Practice Manual when administering treatment to a patient suffering an asthma attack. This decision is particularly noteworthy with an appeal to the High Court of Australia to be heard later this year. We will keep you updated on the outcome.
